Introduction to MBAfinder Service and Web Site
The MBA finder service and Web site ( www.mbafinder.net) ("Site") is operated under the auspices of the Dingman Center for Entrepreneurship ( http://www.rhsmith.umd.edu/dingman/about.html) in the Robert H. Smith School of Business ( http://www.rhsmith.umd.edu) at the University of Maryland ( http://www.umd.edu). Authorized Users may use the Site to engage in the exchange of services for payment. At this time, Authorized Users are limited to students enrolled in graduate and undergraduate programs at the Robert H. Smith School of Business and employers who wish to contract directly with those students for services. Authorized Users must review and accept the following terms and register with the Site as a condition of using the MBA finder service.
Terms of Use
- Authorized Users and Uses: Only students enrolled in graduate and undergraduate programs at the Robert H. Smith School of Business at the University of Maryland and employers who wish to contract directly with those students for services through the MBAfinder.net Web site (the "Site") qualify as Authorized Users of the Site. All Authorized Users must register with the "Site" and agree to abide by these Terms of Use. Authorized Users shall use the Site solely to find and contract with one another for the provision of lawful short-term business services in exchange for compensation.
- Responsibilities of Authorized Users: Authorized Users expressly agree (a) to use the Site only in support of the purpose stated in paragraph 1; (b) to post true, complete and accurate information and refrain from posting misleading, defamatory, libelous, untrue, discriminatory and/or inaccurate material on the Site; (c) not to knowingly distribute viruses or introduce technologies that may harm or interfere with Site operation; (d) not to reproduce, distribute, modify and/or publicly display information transmitted through the Site to or for the benefit of unauthorized users; (e) to undertake sufficient procedures and checkpoints to satisfy their personal requirements for accuracy of data input and output and to maintain a safe and effective means to reconstruct any lost data, and (f) not to discriminate in any manner against other Authorized Users be they employers or students based on race, color, religion, creed, age, sex, marital status, national origin, ancestry, or physical or mental handicap unrelated in nature and extent so as reasonably to preclude the performance of such employment. Authorized Employer Users are responsible for complying with all applicable nondiscrimination laws.
- University Disclaimers: THE UNIVERSITY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, WRITTEN OR ORAL, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR USE, MERCHANTABILITY AND/OR THE CONDITION, INTEGRITY, ACCURACY OF INFORMATION TRANSMITTED AND/OR SERVICES PROVIDED THROUGH THE SITE, THE OPERATION OF THE SITE AND SITE SOFTWARE, THE FREEDOM OF SITE SOFTWARE, SITE CONTENT OR INFORMATION TRANSMITTED THROUGH THE SITE FROM INFRINGEMENT OF THE RIGHTS OF ANY THIRD PARTY AND/OR THAT THE SITE WILL OPERATE AND BE PUBLICLY ACCESSIBLE WITHOUT INTERRUPTION OR ERROR OR BE FREE OF VIRUSES, WORMS OR SIMILAR FLAWS. The University does not review or approve Site communications and disclaims any control over the completeness, timeliness or accuracy of any information posted by Authorized Users, the ability of employers to pay, the ability of students to perform and complete services, and/or the quality of services rendered. The University neither recommends, endorses nor controls who posts listings on the Site except where the employer is the University and is not involved in and does not control any negotiations or terms of contracts, including pricing or payment for services employer and student users may enter. . Such transactions are personal to the employer and student. The University will not knowingly allow an employer that violates such laws to use the Site and will not knowingly permit the posting of any listing that expresses any preference, limitation or discrimination on a discriminatory basis. UNDER NO CIRCUMSTANCES WILL THE UNIVERSITY BE LIABLE FOR THE ACTIONS OF USERS OR ANY INFORMATION PROVIDED BY USERS OR FOR ANY DAMAGES OF ANY KIND RELATED TO THE USE OR MISUSE OF THE MBAfinder SERVICE, INCLUDING SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, LOSS OF BUSINESS OR PROFIT OR GOODWILL.
- Privacy of Information: (a) Information that users provide through the Site will be received on a non-confidential basis. The University reserves the right to use such information in its sole discretion to enhance Site services and better inform the educational activities of the Robert H. Smith School of Business in general. (b) Information that students furnish or that is collected about students through the Site does not qualify as "educational records" and is not subject to University of Maryland Policy and Procedures on the Disclosure of Student Education Records, III-6.30(A) (Approved by the President, August 1, 1991; updated April 15, 1996; June 2, 1997, and October 1, 2002 by the President's Legal Office).
- Passwords: Access to and use of the Site requires users to register their name and password. Users are responsible for protecting the secrecy and use of their password and/or name and will not transfer either to any other person or entity. To the extent permitted by law and consistent with the Policy on the Acceptable Use of Information Technology Resources, http://www.nethics.umd.edu/aup/, the University will treat passwords and user names as private and confidential and will not disclose or share them with any third parties without first obtaining the user's consent.
- Release. Users forever and finally release the University and agree not to sue the University or cause the University to be sued in any judicial or administrative forum with respect to any and all matters relating, directly or indirectly, generally or specifically, to any dispute of any nature and all related claims, demands and damages that may arise between or among one or more users.
- General. (a) This Agreement shall be governed in all respects by the laws of the State of Maryland as they apply to agreements entered into and to be performed entirely within Maryland and between Maryland residents. (b) User agrees that any and all claims or disputes he or she may have against the University will be filed exclusively in the appropriate Federal or State court located in Prince George's County and further agrees to waive his/her right to assert that such forum lacks personal jurisdiction over User or is an inconvenient forum for resolving the underlying dispute. (c) This Agreement does not create and is not intended to create any agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship between the University and any user.
- Notices of claimed infringements of copyright by Users of the Site should be filed as specified at http://www.nethics.umd.edu/resources/factsheets/copyright.html. Questions about the Site and notices of claimed violations of any term of this Agreement may be submitted to feedback@mbafinder.net.
- Termination. The University provides the Site as a service. Access to and use of the Site is a privilege that the University may deny to any user at any time for any reason or no reason without prior notice. The University may stop offering the MBAfinder service altogether at any time without prior notice.
